CHANGES TO MINIMUM WAGE AND EXEMPTION STATUS SALARY FOR 2026

Maintaining compliance with wage and hour laws is essential for all New York employers. As of January 1, 2026, the final phase of the state’s scheduled minimum wage increases has taken effect:

  • NYC, Long Island, and Westchester Counties: $17.00 per hour.
  • Remainder of the State: $16.00 per hour.

Exempt Salary Thresholds A key aspect of compliance involves ensuring that employees classified as “exempt” meet the required salary thresholds. These thresholds have increased, impacting the eligibility of employees for executive and administrative exemptions:

  • NYC, Long Island, and Westchester: The minimum weekly salary is now $1,275.00 ($66,300.00 annually).
  • Remainder of New York State: The minimum weekly salary is $1,199.10 ($62,353.20 annually).

Employers are advised to review current classifications immediately. Failure to meet these requirements may result in liability for unpaid overtime, back pay, liquidated damages and potential legal action.
